Japan Earned 20B Dollars from Intellectual Property Revenues in 2015


Ministry of Finance Japan put out a press release on February 8 stating that Balance of Payments in fiscal year 2015 recorded a surplus of 16.6T JPY (138B USD), that is 6.3 times on a year-on-year basis and increase in trade surplus is for the first time in half a decade, and the first time since the Great East Japan Earthquake.

In particular, the royalty revenues for intellectual properties recorded a surplus of 2.4T JPY (20B USD) that marks the largest-ever.

The Amended Patent Examination Guidelines Will Come into Force in April

In response to the Supreme Court decision on last November, JPO have been preparing the amendment of patent examination guidelines to allow patent term extension (PTE) for a drug patent when the drugs is granted marketing authorization (MA) for different dosage and administration even if the drug has the same ingredients. The draft of amendment was approved by the government committee on February 4th, and it will come into force in April after the process of public comment. The amended guidelines will be applied to the examinations which are conducted after the enforcement date.

Nintendo Finally Won a Unfair Competition Case on Magi-Com (Magic Computert) for Nintendo DS

The Magic Computer is a device which disables copy protection to make illegal game software run on Nintendo DS. Nintendo filed a suit in Tokyo district court against an importer of the magic computers in July, 2009. The Supreme court rejected the importer's appeal on January 12, 2016, confirming import injunction of the magic computers and payment of 95.6M JPY (797,000 dollars) in total.
